The proposal had been submitted to the Swedish parliament (the Riksdag), a few weeks earlier, on 11 May.The proposal includes a brand new Act that will require notification to a government authority, not named in the proposal (but likely the Inspectorate for Strategic Products ISP), of any potential investment into a company operating in a sector which requires special protection.The government proposes that the new Act will enter into effect on 1 December 2023.Relevant sectorsThe proposed Act covers the following sectors:Essential services are those that provide essential functions to society, such as health care, financial services, information and communication, food and transport. Energy supply, financial services and health care are all considered essential. Information and communication, transportation, and food will be decided by the regulatory authority.Security-sensitive activities (covered by the Protective Security Act (SFS 2018:585) (Sakerhetsskyddslagen), aiming to safeguard those activities that are in greatest need of protection from a national security perspective);The prospecting, extraction, enrichment or sale of raw materials, metals, or minerals that Sweden considers to be strategic;Processing of sensitive personal information or location data through or in a product or service.Manufacturing or developing, researching into or supplying military equipment according to the Act (SFS92:1300) regarding military equipment. Or providing technical support for such military equipmentManufacturing or developing dual-use products, conducting research or providing technical assistance to such products.Research or development of new products or technologies within emerging technologies, other strategic protected technology or operations that have the capability to manufacture or develop these products or technologies.Notification is requiredAnyone planning to make a proposal should consider the proposal.
